1. ARTICLE - PHOTOGRAPHER AND CLIENT

Eternal moment is the English translation of Večni trenutek, name under which a team of photographers operates under the leadership of Luka Vabič (ALL-IN.SI, Luka Vabič s.p.) and Ana Vabič (Ana Vabič s.p.), hereinafter referred to as Eternal moment or the photographer. Eternal moment collaborates with a team of photographers who act as co-photographers to the team leaders (Luka and Ana) on the wedding day and have been part of the team for an extended period. The technical knowledge of co-photographers is equivalent to the knowledge of the team leaders.

All content published on the website www.vecni-trenutek.si, including photographs, is the property of Eternal moment and is copyright protected unless otherwise indicated. Appropriation of these works without the written permission of the authors is prohibited.

The client is an individual or legal entity that orders a service from the photographer based on the offered services

2. ARTICLE – CLIENT'S OBLIGATIONS

By ordering and booking the photography service, the client undertakes to be familiar with the execution, price, deadline, date, and payment method, confirming agreement with the general terms. Service prices are published in the price list or offer provided to the client upon inquiry and transmitted via email.

The client must provide accurate information to Eternal moment regarding the scope, timing, location of photography, and their preferences. They are required to complete the record of the wedding day, prepared by Eternal moment, including all necessary information that photographers need for photography. Eternal moment takes into account the recorded information and preferences (if feasible) on the wedding day. The record can be adjusted and supplemented at any time before the wedding. Complaints about missed moments not recorded in the record are not considered after the wedding day.

The client is responsible for providing refreshments for the photographer if the photography lasts more than 6 hours. If refreshments are not provided for the photographers, the client must communicate this in the wedding day record. The photographer is entitled to a break of 90 minutes during the guests’ refreshment time.

The client is solely responsible for their own safety. Eternal moment is not liable for injuries that may occur as a result of photography.

Disputes between Eternal moment and the client are resolved amicably. Under no circumstances should the client publicly (on blogs, forums, social networks, etc.) offend, defame, slander, or shame Eternal moment or the photographers personally. In case of a misunderstanding, Eternal moment will take action according to legal possibilities. If a resolution to any dispute is not reached amicably or if there is public defamation online and on social networks, the client and Eternal moment will resolve the dispute through the appropriate court.

3. ARTICLE - PHOTOGRAPHER'S OBLIGATIONS

Eternal moment is obliged to prepare an offer based on the client’s wishes before signing the contract. Eternal moment must arrive at the agreed-upon location for photography at the agreed-upon time, as stated in the wedding day record.

The photographer will ensure the photography of elements included in the offer. The photographer’s obligations include photographing and accompanying the client on their wedding day. Eternal moment undertakes to, in good faith, try to provide advice and assistance during photography if it is the client’s wish and does not hinder or complicate the photography. The photographer is not a wedding planner.

Eternal moment undertakes to perform the service in accordance with the General Terms of Business. Within the agreed-upon timeframe, the photographer will execute the agreed-upon service and deliver the final product. The photographer is solely responsible for their own safety.

4. ARTICLE – DATES AND LOCATIONS

Eternal moment and the client will specify the exact date, time, and location of the photography at least 7 days before the commencement of the service.

5. ARTICLE - RESERVATION AND PAYMENT OF ADVANCE

The customer confirms the reservation of the date and orders the services by paying an advance in the amount of 300 EUR. The date is not reserved until the advance payment is made, unless otherwise agreed between Eternal moment and the customer. The customer’s reservation is confirmed with the payment of the advance, and the selected photography package is definitively reserved.

 

The price of the paid advance includes the reservation of the chosen date for the photography session. Expertise, photography time, photo editing, digital photos, and printed products are not included in the advance payment. The already paid advance is deducted from the final amount. The remaining amount for the photography session (a total of 100% of the amount) is settled up to 3 days before the photography service is provided, by a bank transfer to the account provided by Eternal moment. In the event of non-payment within the agreed time, Večni trenutek is not obliged to provide the service, and the paid advance is retained.

6. ARTICLE – CANCELLATION OF SERVICE

If the customer cancels the order, Eternal moment retains the paid advance. If the advance has not been paid, Eternal moment issues an invoice for the cancellation of the photography session reservation in the amount of 300 EUR upon cancellation of the order. If the customer cancels the order due to unforeseen events beyond their control (force majeure – death, death in the immediate family, a serious accident, complications in pregnancy, quarantine orders, etc.), the customer will be refunded the paid advance upon presenting proof.

In the case of rescheduling the photography session, Eternal moment undertakes to make every effort to find and offer a new available date for the photography session.

If the customer chooses a date on which Eternal moment is available, the paid advance is transferred as a reservation for the new photography session date. If the advance has not been paid, it is paid upon the reservation of the new photography session date in the amount of 300 EUR.

If the customer chooses a date on which Eternal moment is not available, the paid advance is retained. If Eternal moment cannot offer an alternative date, the advance is retained. If the advance has not been paid, Eternal moment issues an invoice for the cancellation of the photography session reservation in the amount of 300 EUR in the case of rescheduling or cancellation.

7. ARTICLE – DISTRIBUTION AND UNIQUENESS OF SERVICE

After capturing the wedding day, Eternal moment selects the best photos from all taken images and digitally processes them in the agreed-upon editing style. The finished products are delivered to the customer within the agreed-upon timeframe. The customer receives digital copies of the photos on a portable medium by mail, and in some cases, also in person. The customer will receive the photos in digital format no later than 12 weeks after the photography session. In case of unforeseen events (force majeure – death, death in the family, severe illness, quarantine orders, pregnancy or complications in pregnancy, etc.) or rescheduling of other customers’ weddings and an increased workload due to measures to prevent the spread of the coronavirus, Eternal moment reserves the right to deliver photos and products later than agreed upon.

The customer receives the first 10 – 30 photos of the wedding day no later than 10 days after the wedding. The delivery time for photo books and other printed products depends on the order date and the estimated delivery time of the printing company.

Eternal moment will do its best to meet the customer’s expectations and consider their preferences during the photography session. Since each photograph is the result of the photographer’s knowledge and current creativity, Eternal moment does not allow complaints about the composition and technique of the photos. The selection of the best photos and their processing is also subject to the artistic inspiration of the photographers. Unprocessed photos (RAW photos) are not available for purchase as they are not considered the final product. Eternal moment undertakes to provide the number of photos within the range specified in the offer. The number of photos may vary depending on the complexity of the wedding, weather conditions, and other circumstances on the wedding day.

All photographic materials are and remain the property of the photographers as copyrighted work and intellectual property. The photographer grants part of the material copyright to the customer upon payment of the service, specifically the right to reproduce photos for non-commercial use. The photographer reserves the right to publish photos for marketing purposes and references. Eternal moment may publicly publish photos for promotional purposes on its website, social media, own printed materials, and third-party pages intended for promotion, unless the customer does not permit this and informs Eternal moment in writing. In case of photo publication, the customer must credit the author as “photo: Večni trenutek.” Permission from Eternal moment is required for commercial publication in the media. Forwarding photos to other wedding service providers (makeup artists, florists, wedding planners, wedding blogs, etc.) is allowed with appropriate attribution. Forwarding photos to other photographers is prohibited.

8. ARTICLE – WEDDING DAY RESERVATIONS

Eternal moment can accept two full-day and one shorter wedding photography reservations for a single day. The Eternal moment team provides the customer with a team of two photographers, consisting of a lead photographer and a second photographer. In the case of double reservations, the customer does not specify a preference for a particular photographer, as Eternal moment’s work is uniform regardless of the team composition capturing the wedding day. All photographers at Eternal moment are qualified and ensure a high-quality service. On the wedding day, they will proudly represent the Eternal moment team and deliver a quality service.

9. ARTICLE – NON-PERFORMANCE OF SERVICES

In the event that one or both photographers from the team scheduled to be present on the customer’s wedding day are unable to perform the customer’s service due to unforeseeable events beyond their control (force majeure – death, death in the family, severe illness, quarantine order, pregnancy or complications in pregnancy, etc.), Eternal moment will make every effort to provide a replacement for the absent photographer from their team of photographers or photographers outside their team according to the customer’s choice. If the replacement of photographers is not possible, and the execution of the service by Eternal moment is not possible due to force majeure, the received deposit will be refunded to the customer, and Eternal moment will have no further obligations towards the customer.

10. ARTICLE - GIFT VOUCHER AND DISCOUNTS

The use of the gift voucher is unlimited. Reservation of the photography session is possible subject to availability. Eternal moment is not responsible for late reservations by the customer. The exchange of the gift voucher for cash is not possible. If the voucher specifies the beneficiary, only that person can use the voucher, meaning that the gift voucher is not transferable.

Discounts do not accumulate. The discount is only valid for the price or package specified on the voucher and not for other services (additional photos, photo book, other products), unless otherwise stated.

11. ARTICLE – EXTENSION OF SERVICE TIME

Eternal moment undertakes to perform its services on the day of the photography session until the bouquet toss and garter toss (unless otherwise agreed) or until one in the morning (01:00). After one in the morning (01:00), the photographers’ work is subject to an additional charge of €100 per hour for each additional hour (or until the bouquet toss or garter toss within the additional hour) when the Eternal moment team is officially present at the wedding.

12. ARTICLE – EXTRAORDINARY EVENTS

During the wedding photography, guests and clients must not obstruct the photographers from taking their shots. If the photographers miss a particular moment due to interference from guests (disruption during work or obstruction in front of the camera), Eternal moment is not responsible for it.

In the event of unforeseen circumstances (malfunctions, cancellations, theft, or damage to photographic equipment, computers, or hard drives) that occur during photography, photo editing, or photo distribution, resulting in the client not being able to receive all or part of the photos, Eternal moment is not responsible for the loss of the original captured photos. However, Eternal moment undertakes to refund the client the paid amount for the photography service.

After the distribution of photos on a USB drive and upon receipt of the photos, the client is solely responsible for the photos and their storage. Eternal moment will retain the originals for an additional 14 days after sending the photos, but is not responsible for any loss or potential damage to the USB drive by the client.

13. ARTICLE - PROTECTION OF PERSONAL DATA

Eternal moment undertakes to protect the personal data obtained during the reservation process of the photography service in accordance with the Personal Data Protection Act. Eternal moment will not use the personal data of clients for any purpose other than exclusively for the quality execution of photography, communication with the client, and the delivery of photos to the client. Personal data is stored permanently. Without the explicit prior written consent of the client, Eternal moment will not disclose personal data to third parties or use them for purposes other than those stated in this article.

14. ARTICLE - VALIDITY OF THE CONTRACT AND GENERAL TERMS AND CONDITIONS OF BUSINESS

The general terms and conditions of business are published on the website www.vecni-trenutek.si. By reserving the photography service with Eternal moment, the client undertakes to have read the general terms and conditions of business, be familiar with them, agree with them, and commit to respecting them. Eternal moment reserves the right to change the general terms and conditions of business at any time.
